Terms of Service

Last updated:

These Terms of Service are the agreement between you and Yay Bestie when you use yaybestie.com or buy a personalized gift from us. We have tried to write them the way we would explain them across a counter: plainly, with examples, and without hiding anything important in small print. Please read them before you order. By browsing the site, creating an account or placing an order, you agree to these terms. If you do not agree, please do not use the site.

“Yay Bestie”, “we”, “us” and “our” mean Yay Bestie, 6230 Belmont Trail Ct, San Diego, CA 92130, United States. “You” means the person using the site or placing an order. You can contact us at support@yaybestie.com.

The key points

  • Everything is made to order with the personalization you provide, so please check it carefully; we print what you type.
  • Prices are in US dollars. Shipping is free to the United States, Canada, Australia and New Zealand, the only countries we deliver to.
  • You can change or cancel within 24 hours of ordering, before production starts, and return any item within 60 days of delivery, with return postage paid by us.
  • You keep ownership of the words and images you give us; you give us permission to use them only to make and support your order.
  • Nothing in these terms takes away rights you have under consumer protection laws where you live.
  • These terms are governed by the laws of the State of California.

1. Who can use the site and buy from us

You must be at least 18 years old, or the age of majority where you live, to place an order. If you are younger, a parent or guardian must place the order and accept these terms for you. You agree that the information you give us, including your name, email, billing details and shipping address, is accurate and that you are authorized to use the payment method you choose.

We sell to customers who want gifts for personal use. If you are buying for resale, or for a large corporate order, please contact us first so we can agree terms that fit; standard retail terms may not apply to those orders.

2. How our products work

Yay Bestie sells personalized mugs, ornaments, table lamps and night lights, home decor such as plaques, pillows, blankets and magnets, and small fun gifts such as keychains, car hangers and suncatchers. Each product page describes the item, its material, its size options and the personalization it accepts.

Every item is made to order after you buy it. That has a few consequences you should know about:

  • Production time: we make and pack your order within 1–3 business days after payment is confirmed, before the carrier’s transit time begins. Our Shipping & Delivery page explains the full timeline.
  • Small variations: natural wood has grain, knots and colour variation; printing and engraving can vary slightly from piece to piece; screens show colours differently. Product photos and previews show the design and layout faithfully, but an item may differ slightly in shade or texture from what you see on screen. These natural differences are not defects.
  • Illustrations, not portraits: where a design uses a character, pet or person illustration, it is a stylised drawing chosen from the options shown, not a likeness of a specific person or animal, unless the product page clearly says it accepts a photo.
  • Measurements: sizes such as “4 in” or “15 oz” are nominal sizes for the product family. Exact measurements can vary slightly because of the manufacturing process; see the Size Guide for help choosing.

3. Your personalization

When you personalize an item, you are giving us instructions. We reproduce the text exactly as entered, including spelling, capital letters, spacing and punctuation, and we do not correct spelling unless you ask us to. Please read the preview and your order summary before paying. You can change the personalization within 24 hours of ordering if production has not started, as described on our Cancel or Change an Order page.

You are responsible for the content you submit. By placing an order, you confirm that:

  • you have the right to use the names, words, images and other material you provide;
  • the content does not infringe anyone’s copyright, trademark, privacy or publicity rights, for example by using a sports team’s logo, a cartoon character, a company’s brand, song lyrics you do not have permission to use, or someone else’s photograph;
  • the content is not unlawful, threatening, harassing, hateful, sexually explicit, or intended to demean any person or group.

We may decline to make an item whose personalization breaks these rules or our Intellectual Property Policy. If that happens, we will contact you, offer you the chance to change the wording, and refund you in full if we cannot agree on a version we can produce. We review personalization for obvious problems, but we are not able to check every name, phrase or reference, and responsibility for the content stays with the person who submitted it.

4. Permission to use your content

You keep all rights in the words and images you send us. You give Yay Bestie a limited, non-exclusive, royalty-free permission to use, copy, adapt (for example resize or recolour) and print that content only as needed to make, ship and support your order, including remakes and exchanges. We do not use your personalization in our marketing, on our website or on social media without asking you first and receiving your written permission.

5. Prices and currency

All prices are shown in US dollars. The price of each item and any option, such as a larger size, is shown on the product page and again in your cart and at checkout before you pay. Shipping to the United States, Canada, Australia and New Zealand is free and is shown as $0.00 at checkout. We do not add sales tax at checkout. If you order to Canada, Australia or New Zealand, the destination country may charge import duties, taxes or fees when the parcel arrives; those are not part of our price and are the recipient’s responsibility.

We work hard to keep prices accurate. If a price on the site is clearly wrong because of a technical or typing error, for example a mug listed at $1.99 instead of $19.99, we are not obliged to sell at the wrong price. We will contact you before shipping, explain the error and let you choose to pay the correct price or cancel for a full refund. Prices can change over time, but the price you pay is the one shown at checkout when you place your order.

6. Placing an order and when the contract starts

When you click to place your order, you are making an offer to buy the items in your cart at the prices shown. We send an order confirmation email to acknowledge that we received it. The contract between us is formed when we confirm your order by that email. We may decline or cancel an order before production in limited cases: if a payment is not authorized or is reversed, if an item or option is no longer available, if the personalization cannot be produced under section 3, if there is an obvious pricing error, or if the order shows clear signs of fraud or misuse. If we cancel for any of these reasons, we refund everything you paid within 7 days.

7. Payment

The payment methods available for your order are shown at checkout. Payments are processed by a third-party payment provider; we do not see or store your full card details. By submitting payment, you confirm you are authorized to use that method and authorize the charge of the total shown at checkout. If a payment is declined, the order is not placed. Our Payment Methods page has more detail on how checkout works and what to do if a payment fails.

8. Shipping, title and risk

We ship only to addresses in the United States, Canada, Australia and New Zealand. Delivery times shown on the site are estimates made of our 1–3 business day production time plus the carrier’s 7–14 business day transit estimate; they are not guaranteed delivery dates. Ownership of the item passes to you when we hand the parcel to the carrier. Risk of loss also passes to you on delivery, but if a parcel is lost or damaged in transit we still replace it or refund you as described on our Shipping & Delivery page. You are responsible for giving a complete and correct shipping address; if a parcel is returned to us because of an incomplete or incorrect address, we will reship it once you confirm the correct one.

9. Changes, cancellations, returns and refunds

You can change or cancel an order within 24 hours of placing it, as long as production has not started. After that, any item can be returned within 60 days of delivery for any reason, including personalized items, and we pay the return postage. Damaged, faulty and incorrect items are replaced or refunded when reported with photos within 60 days. Approved refunds are sent to your original payment method within 7 days. The full rules are part of these terms and are set out on our Cancel or Change an Order, Returns & Exchanges Policy and Refund Policy pages. If anything on those pages seems to conflict with these terms, the version more favourable to you applies.

10. Gift orders sent to someone else

Many orders go straight to the person being celebrated. When you enter someone else’s name and address as the shipping details, you confirm you have their permission, or a reasonable expectation that they would welcome a gift, to share that address with us and our carrier. The contract remains between you and us: you are the customer, refunds go to your payment method, and only you can change the order or its delivery address. The recipient may still contact us about a damaged item or an exchange, and we will help them in a way that respects your privacy, for example without revealing the price. Packing slips do not show prices.

11. How we communicate with you

By placing an order, you agree that we may contact you by email about it: order and shipping confirmations, questions about your personalization, delays, and replies to your messages. These are service messages, not marketing, and they are part of providing your order. We do not send marketing emails today; if we ever start, you will only receive them if you opt in, and you can unsubscribe at any time. Notices we are required to give you under these terms may be sent to the email address on your order or account, and count as received when sent unless we learn they were not delivered.

12. Your account

You can buy as a guest or create an account. If you create one, keep your password private and tell us straight away if you think someone else has used it. You are responsible for activity on your account that happens because you shared your password. We may suspend or close an account that is used for fraud, abuse of our staff or systems, or repeated breaches of these terms, and we will tell you why unless the law or an investigation prevents it. You can close your account at any time by emailing us.

13. Our content and brand

The Yay Bestie name, the speech-bubble logo, our product designs and illustrations, page text, photos and the layout of the site belong to Yay Bestie or to the people who licensed them to us, and are protected by copyright, trademark and other laws. You may view the site and share links to it. You may not copy, sell, republish or create products from our designs, text or images, or use our name or logo in a way that suggests we endorse you, without our written permission. Buying a personalized item gives you ownership of that physical item, not the right to reproduce its design.

14. Acceptable use of the site

Please use yaybestie.com the way it is intended: to browse, ask questions and buy gifts. You agree not to:

  • break any law or encourage anyone else to do so while using the site;
  • submit personalization or messages that are unlawful, hateful, harassing, sexually explicit or that infringe someone else’s rights;
  • try to gain unauthorized access to the site, our systems or other customers’ information, or test our security without permission;
  • upload or send viruses, malicious code or anything designed to damage or overload the site;
  • use robots, scrapers or automated tools to copy large parts of the site, place orders or create accounts, except for search engines indexing public pages under our robots.txt rules;
  • place orders using someone else’s payment details without their permission, or make false damage or non-delivery claims;
  • impersonate another person or misrepresent your connection with anyone.

We may refuse service, cancel orders or block access where we reasonably believe these rules have been broken.

15. Links to other websites

The site may link to websites we do not control, such as a carrier’s tracking page or a payment provider’s checkout. We are not responsible for their content, availability or privacy practices, and a link is not an endorsement. Your use of those sites is governed by their own terms.

16. Product care and safe use

Please follow the care notes on each product page. In particular: printed mugs are dishwasher- and microwave-safe unless stated otherwise, but metallic accents and hand-washing recommendations noted on a product page should be respected; night lights and lamps are decorative lights for indoor use, not reading lamps or toys, and should be used with the power source supplied or described; glass bottle lamps are fragile and should be kept out of reach of small children; car hangers must never block the driver’s view and may be restricted by road rules where you drive; small items such as keychains and ornaments with small parts are not toys for young children. Using a product against its care notes or for a purpose it was not designed for is at your own risk.

17. Our responsibility to you

We will make your items with reasonable care and skill, as described on the product page, and deliver them as described in our shipping policy. If we fall short, the remedies in our returns and refund policies apply, together with any rights you have under the law.

What we are not responsible for. To the extent the law allows, Yay Bestie is not liable for: losses that were not reasonably foreseeable when the contract was formed; indirect or consequential losses, such as lost profits, lost opportunities or disappointment at a missed occasion caused by a carrier delay beyond our control; errors in personalization text that you entered; natural variation in materials described in section 2; or problems caused by misuse, accidents after delivery or failure to follow care notes. To the extent the law allows, our total liability to you for any order is limited to the amount you paid for that order.

The site is provided “as is” and “as available”. We work to keep it accurate, secure and online, but to the extent the law allows we do not promise that it will always be available, error-free or free of harmful components, and we disclaim implied warranties that cannot be shown to apply. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.

18. Your consumer rights

These terms do not take away rights you have under consumer protection law. If you are in Australia, our goods come with guarantees that cannot be excluded under the Australian Consumer Law, and you are entitled to a replacement or refund for a major failure and compensation for other reasonably foreseeable loss or damage. If you are in New Zealand, the Consumer Guarantees Act 1993 gives you rights that we cannot exclude when you buy goods for personal use. If you are in Canada or the United States, any rights you have under your provincial, territorial or state consumer laws continue to apply. Where these terms and a mandatory consumer law conflict, the law wins.

19. If you are responsible for a claim against us

If someone makes a claim against Yay Bestie because content you supplied for personalization infringed their rights, or because you broke these terms or the law, you agree to cover our reasonable costs of dealing with that claim, including reasonable legal fees, to the extent the claim was caused by you. This does not apply where the claim was caused by our own fault, and it does not limit your consumer rights.

20. Solving problems and governing law

Most problems are fixed with one email, so please contact us at support@yaybestie.com first and give us a chance to put things right; we reply within one business day. If we cannot resolve a dispute informally within 30 days, either of us may take it further.

These terms, and any dispute about them or about an order, are governed by the laws of the State of California, United States, without regard to its conflict-of-law rules. Disputes will be heard by the state or federal courts located in San Diego County, California, and both of us agree to their jurisdiction, except that either of us may bring an individual claim in a small claims court that has jurisdiction. If you are a consumer living outside the United States, you may also be entitled to bring proceedings in the courts of your own country, and the mandatory consumer laws of your country continue to apply to you.

21. Things outside anyone’s control

We are not responsible for delays or failures caused by events beyond our reasonable control, such as severe weather, natural disasters, carrier or postal disruptions, customs delays, power or internet outages, strikes, public health restrictions or shortages of materials. If such an event affects your order, we will tell you as soon as we can and, if the delay becomes unreasonable, offer you a full refund.

22. Changes to these terms

We may update these terms when our products, services or the law change. The date at the top shows the current version. The terms that apply to your order are the ones in force when you placed it. If we make a change that significantly affects existing orders or accounts, we will tell you by email or with a clear notice on the site.

23. Other legal points

If any part of these terms is found to be invalid or unenforceable, the rest stays in force, and the invalid part is applied as far as the law allows. If we do not enforce a right straight away, we can still enforce it later. You may not transfer your rights under these terms to someone else without our agreement; we may transfer ours to a business that takes over Yay Bestie, as long as your rights are not reduced. These terms, together with the policies they refer to and our Privacy Policy, are the entire agreement between us about your use of the site and your orders.

24. Contact

Questions about these terms can go to support@yaybestie.com, through our Submit Ticket page, or by post to Yay Bestie, 6230 Belmont Trail Ct, San Diego, CA 92130, United States. For quick answers about orders, the Help Center and FAQs are usually faster.
